Temporary Erosion and Sediment Control

As of October 1st, 2009, the City of Issaquah is changing the requirements for Temporary Erosion and Sediment Control (TESC) at Construction Sites

Summary of Changes:

· The separate Wet Weather Permit previously required to work during the winter has been discontinued.

· To improve efficiency, the Wet Weather Permit and TESC requirements will now be addressed in the Public Works permit for the project (typically a clearing and grading permit).

· A separate Public Works permit for TESC will be required for projects that don’t require a clearing and grading permit.

· The 100 NTU turbidity discharge limit included in the Wet Weather Permit will now be effective year-round, for the life of the project.

· TESC permit coverage is required for all land disturbing activities (with some exceptions).

· Plan submittal requirements are revised  to follow the 2009 King County Surface Water Design Manual.

· Security deposit and enforcement procedures are also changed.

· Designated TESC supervisors shall be a Certified Erosion and Sediment Control Lead (CESCL).

New Submittal Requirements:

· Submit the following with your permit application:

1) TESC Plan - site plans showing TESC measures.

2) TESC Report - description of TESC measures.

3) Stormwater Pollution Prevention and Spill Plan - description of spill control measures.

· See the Public Works Engineering TESC web page at the 2009 King County Surface Water Design Manual, as amended by the City of Issaquah, for more information on submittal requirements.

· The TESC plans and report shall address all phases of construction.

· Providing a copy of a Stormwater Pollution Prevention Plan (SWPPP) prepared for Ecology for a Construction Stormwater Permit meets the submittal requirements for the TESC Report and Stormwater Pollution Prevention and Spill Plan.

Site Discharge Monitoring Expanded:

· To be in compliance with the permit, discharge from the project site shall not exceed 100 NTUs at all times up to the 10 year/24 hour storm event (3.5 inches over 24 hours, as measured at the City’s rain gage.

· City inspectors will monitor the turbidity of the runoff discharging from the site to verify compliance. 

· Site discharge monitoring will be conducted year-round.

· Monitoring points will be designated on the TESC plans for all phases of construction.

· Monitoring points shall be:

1) Located in a catch basin, pond, sump, pipe, or similar structure where runoff can be monitored for compliance,

2) Readily accessible to City personnel,

3) Located at or near the property boundary,

4) Located so that all site runoff drains to the designated monitoring points.

Security Deposit Revised:

· A security deposit is required for the duration of the permit.  This deposit will only be used to cover costs incurred by the City to repair or mitigate impacts due to a failure of the applicant to install or maintain TESC measures.

· The amount of the security deposit will be $750, $2000, or $5000, depending on the size and scope of the project.

· A single deposit may apply to a plat or to multiple parcels, depending on the project.

· The deposit may be waived for projects of short duration or for special circumstances.

New Enforcement Procedures:

·  The City may issue a Stop Work Order and/or issue a civil penalty through Code Enforcement for permit violations.

·  Enforcement is only used as the last resort!

·  Civil penalties that may be applied for exceeding the discharge limits are:

Exemptions: 

 

The following activities are exempt from compliance with these requirements:

 

1. The cutting of non-protected, protected and significant trees as defined in IMC18.12.

 

2. Routine landscape installation and maintenance involving not more than 30 cubic yards of excavation and fill on a single parcel of property within a consecutive 12 month period, provided that no materials are stockpiled on city streets (unless permitted under Street Use Permit) and reasonable efforts are made to prevent erodible materials from entering drainage facilities or surface waters;

 

3. Emergency situations involving immediate danger to life or property, substantial fire hazards or other public safety hazards within 7 days of the onset of the emergency or during the period covered by an emergency declaration by the City; provided verbal authorization is provided by the city and followed up with written authorization communicating the need and verifying the nature of the emergency.

 

4. Routine agricultural activities such as plowing, harrowing, disking, ridging, listing, leveling and similar operations to prepare a field or crop;

 

5Fill or excavation in association with mineral resource extraction or processing in a mineral resource zone (“M”) regulated by IMC 18.07.335;

 

6. Cemetery graves;

 

7. Removal of non-native invasive plant species from environmentally critical lands and Native Growth Protection Easements in accordance with IMC 18.10.400.

 

8. Small projects with a total duration of seven days or less that will be performed during dry weather, if the project is fully stabilized at completion, and no prohibited discharges occur per IMC 13.28.025.  During the wet season this period can be shorter if weather conditions cannot be accurately predicted.  This exemption requires notification to the City to approve start of work and monitor the activity to verify conformance with this exemption.

 

9.  Projects that have no potential to discharge turbid stormwater runoff or sediment to a public drainage facility or surface water and cause a violation of water quality standards.  Factors that would be considered in exempting an activity include but are not limited to: likelihood of drainage leaving the site or entering surface water, soil type and its potential to erode, size and duration of proposed activity, and steepness of slope.

 

TESC is now under the Public Works Permit for your project, not a separate Wet Weather Permit.

 

What You Need To Do Now:

  • TESC must be in place by October 1st.
  • Submit revised TESC plans if updates are needed to reflect current conditions.
  • Turbidity monitoring will begin October 1st.
