As of October 1st, 2009, the City of Issaquah is changing the requirements for Temporary Erosion and Sediment Control (TESC) at Construction Sites
Summary of Changes:
· The separate Wet Weather Permit previously required to work during the winter has been discontinued.
· To improve efficiency, the Wet Weather Permit and TESC requirements will now be addressed in the Public Works permit for the project (typically a clearing and grading permit).
· A separate Public Works permit for TESC will be required for projects that don’t require a clearing and grading permit.
· The 100 NTU turbidity discharge limit included in the Wet Weather Permit will now be effective year-round, for the life of the project.
· TESC permit coverage is required for all land disturbing activities (with some exceptions).
· Plan submittal requirements are revised to follow the 2009 King County Surface Water Design Manual.
· Security deposit and enforcement procedures are also changed.
· Designated TESC supervisors shall be a Certified Erosion and Sediment Control Lead (CESCL).
New Submittal Requirements:
· Submit the following with your permit application:
1) TESC Plan - site plans showing TESC measures.
2) TESC Report - description of TESC measures.
3) Stormwater Pollution Prevention and Spill Plan - description of spill control measures.

· The TESC plans and report shall address all phases of construction.
· Providing a copy of a Stormwater Pollution Prevention Plan (SWPPP) prepared for Ecology for a Construction Stormwater Permit meets the submittal requirements for the TESC Report and Stormwater Pollution Prevention and Spill Plan.

Site Discharge Monitoring Expanded:
· To be in compliance with the permit, discharge from the project site shall not exceed 100 NTUs at all times up to the 10 year/24 hour storm event (3.5 inches over 24 hours, as measured at the City’s rain gage.
· City inspectors will monitor the turbidity of the runoff discharging from the site to verify compliance.
· Site discharge monitoring will be conducted year-round.
· Monitoring points will be designated on the TESC plans for all phases of construction.
· Monitoring points shall be:
1) Located in a catch basin, pond, sump, pipe, or similar structure where runoff can be monitored for compliance,
2) Readily accessible to City personnel,
3) Located at or near the property boundary,
4) Located so that all site runoff drains to the designated monitoring points.
Security Deposit Revised:
· A security deposit is required for the duration of the permit. This deposit will only be used to cover costs incurred by the City to repair or mitigate impacts due to a failure of the applicant to install or maintain TESC measures.
· The amount of the security deposit will be $750, $2000, or $5000, depending on the size and scope of the project.
· A single deposit may apply to a plat or to multiple parcels, depending on the project.
· The deposit may be waived for projects of short duration or for special circumstances.
New Enforcement Procedures:
· The City may issue a Stop Work Order and/or issue a civil penalty through Code Enforcement for permit violations.
· Enforcement is only used as the last resort!
