Development Commission

The Development Commission (DC) reviews Site Development Permits (SDPs, Sign Permits, and other land use actions requiring a public hearing Level 3 review).  The Commission further serves as an advisory board to the City Council on Master Site Plans and all other land use actions requiring City Council approval (Level 5 review).

The appearance of fairness doctrine prohibits Development Commission members and City Council members from discussing the merit of specific land use development applications outside of the formal public meeting process.  This applies to development application review by the Development Commission and review and/or appeals that will or could be heard by the Council on appeal.

In reviewing land use development applications, the Development Commission and City Council act in a quasi-judicial capacity, like a court or judge, and the Commission and Council are therefore required to follow certain state law and Constitutional due-process rules.  Specifically, the courts have ruled that discussions about a pending application should occur only at a formal public hearing where all interested parties have an equal opportunity to participate.  Citizens, however, may discuss any issue with the City Planning Department.  Written comments are also welcome.

The Commission consists of seven members and seven alternate positions.  The commissioners are community volunteers appointed to the Commission by the Mayor.  Each member serves a four-year term, while the alternates serve a two-year term.
